Acceptance of Terms
Welcome to www.nitishkumar.info. By accessing this website or enrolling in any training program operated under Vivaa Technologies, you agree to comply with these Terms and Conditions, our Privacy Policy, Refund Policy, and applicable laws.
General Policies
- Usage Policy: This platform is dedicated to quality training and technology services. Misuse, illegal activity, or unauthorized use may result in suspension and legal action.
- Intellectual Property: Course materials, code samples, banners, designs, and documents are the exclusive intellectual property of Nitish Kumar and Vivaa Technologies. Unauthorized copying, redistribution, or repurposing is prohibited.
- Terms Update Policy: These terms may be revised anytime and updates will be reflected on this page. Continued use implies acceptance of revised terms.
- Privacy and Data Protection: Student/client data is used for communication, verification, and operational needs only. We do not sell personal data.
- Force Majeure: In case of natural disasters, pandemics, technical breakdowns, or regulatory restrictions, schedules/services may be modified without liability for resulting delays.
Course and Training Terms
- Course Enrollment: Admission form submission is not final admission. Admission is confirmed only after fee payment, seat confirmation, and registration number generation.
- Fees and Payment Policy: Fees are non-refundable and non-transferable. Delayed payment may suspend access. EMI (up to 3 installments) may be available for courses above INR 3000 in approved cases.
- Lifetime Validity and Rejoining: After full payment, students may access course validity while course remains active. Rejoin rights may be provided for the same course subject to policy and feasibility.
- Placement Support: Applicable only after successful completion of required coursework, assignments, and projects.
- Course Duration Extension: Special extension may be approved in cases such as medical or documented constraints.
- Discount and Offer Validity: Promotions are valid only for stated durations and must be verified through official channels.
- Partner and Referral Terms: Policy changes apply to new enrollments; existing admissions retain terms active at enrollment time unless otherwise notified.
- Student Code of Conduct: Abuse, spamming, credential sharing, or misconduct can lead to suspension/termination without refund.
- Attendance and Access Control: Access to live sessions/materials is for registered students only. Redistribution or misuse of content is prohibited.
- Certificate Issuance: Certificate eligibility requires full payment, required attendance (where applicable), and completion of required academic work.
- Course Content Updates: Modules may be updated, removed, or enhanced based on industry needs and curriculum improvements.
- Technical Responsibility: Students must maintain stable internet/device setup; disruption on user side is user responsibility.
- Class Recording Policy: Recordings are revision-only and may be time-bound; downloading/screen-recording/redistribution is prohibited.
WhatsApp Communication Consent
By submitting your mobile or WhatsApp number through our website, admission forms, inquiries, or service onboarding, you expressly consent to receive WhatsApp communications from Vivaa Technologies for admissions, reminders, support updates, fee reminders, batch notifications, and relevant official communication.
- Consent is treated as opt-in communication permission.
- You can opt out of non-essential messages by contacting support or using available unsubscribe methods.
- Transactional or compliance-critical communications may continue where legally required.
Web Development Services Terms and Conditions
- Scope of Work: Features/pages/functionality are mutually agreed before project start. Out-of-scope requests are billed separately.
- Payment Terms: Projects under INR 10,000 require 100% advance. Higher-value projects follow milestone payments (50/25/25).
- Timeline and Delays: Delivery timeline depends on scope and client-side approvals/content timelines.
- Client Responsibilities: Client must provide content/assets on time; domain/hosting responsibility remains with client unless agreed otherwise.
- Revisions: Up to 2 rounds of minor revisions may be included; major changes are chargeable.
- Delivery and Deployment: Final deployment/admin credentials are shared only after full settlement.
- Maintenance: Limited post-delivery maintenance window may be provided; AMC available separately.
- Cancellation and Refunds: Cancelled projects do not qualify for refund. Completed work may be delivered as-is.
- IP Ownership: Client receives agreed rights after full payment; core reusable backend/code logic remains developer IP unless written transfer exists.
- Portfolio Rights: Completed projects may be shown in portfolio unless client opts out via prior written request.
Governing Law and Policy Changes
These Terms are governed by the laws of India, with jurisdiction in Rajasthan courts. We may revise terms from time to time and updated terms become effective upon publication.
